Subject to the conditions and terms stated in this warranty, Synthetics International warrants it product for a term of fifteen (15) years for manufacturing defects. Synthetics International warranty will also warrant concrete moisture as shown in printed literature, when Synthetics International’s required application instructions, approved application methods and any other technical information stipulated in Synthetics International’s literature are strictly followed. Synthetics Internationals products found defective within said period, Synthetics International at its option, will provide the labor and materials to replace the failed and/or defective Synthetics International product and/or damaged flooring system with same or a comparable product(s) at manufactures discretion. Synthetics International reserves the right to test any alleged product failure and provide a determination in writing within 90 days of notification. Synthetics International’s warranty is in lieu of any other warranty, expressed or implied, including without limitation, any warranty of merchantability or fitness for a particular purpose. To the extent any implied warranty is required by law, it is limited in duration to the express warranty period. Neither the manufacturer, nor its distributors or representatives shall be liable for any incidental, consequential, indirect, special or punitive damages of any nature, including without limitation, lost profits, loss of facility usage, attorney fees, laboratory fees, inspection fees or any other damage whether based in contract, tort, or otherwise. No other warranty is expressed or implied. In the event of a possible claim, warranty must be presented, in writing, within 30 days of the flooring issue. Subject to the above mentioned, the sole and exclusive remedy due to a breach of this warranty shall be expressly limited to the repair of the defective areas due to the failure of Synthetics International defective products, and shall expressly exclude consequential damages including, but not limited to damages to structure or to contents of structures. Synthetics International is not responsible for acts of god, structural failure, acts of war and workmanship not in accordance with written technical documents and standard industry procedures.
